Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Prum AI mobile application (“App”) or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Account Registration

You may sign in using your Google or Apple account. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You agree to notify us immediately of any unauthorized access at support@prumai.app.

4. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device(s) solely for your personal, non-commercial purposes, subject to these Terms.

You may not: reverse-engineer, decompile, or disassemble the App; use the Service for any unlawful purpose; attempt to gain unauthorized access to any part of the Service; or use automated scripts to access the Service.

5. User Content

You retain ownership of all photos and content you upload (“User Content”). By uploading User Content, you grant us a limited, worldwide, royalty-free license to process, store, and display it solely to provide the Service.

You represent and warrant that:

• You own or have the necessary rights to submit your User Content.
• Your User Content does not violate any third-party rights (including intellectual property or privacy rights).
• Your User Content does not contain illegal, offensive, or harmful material.

We reserve the right to remove any User Content that violates these Terms.

6. AI-Generated Content

Images generated by the Service (“Generated Content”) are provided for personal, non-commercial use. We do not guarantee that Generated Content is accurate, suitable for any particular purpose, or free from errors. Generated Content may not be used to mislead, deceive, or harm others.

You may use Generated Content for personal use, including saving and sharing. Commercial use of Generated Content requires a separate written agreement with us.

7. Subscriptions and Payments

Certain features require a paid subscription or the purchase of credits (“In-App Purchases”), processed through the Apple App Store or Google Play Store. All purchases are subject to the payment terms of the applicable platform.

• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Refunds are handled by Apple or Google according to their respective refund policies.
• Credits are non-transferable and expire as described at the time of purchase.
• We reserve the right to change pricing with reasonable notice.

8. Prohibited Conduct

You agree not to use the Service to:

• Generate content that is illegal, hateful, sexually explicit, or violates anyone’s privacy.
• Infringe upon any intellectual property rights.
• Distribute malware or attempt to disrupt the Service.
• Circumvent any access controls or usage limits.
• Harvest or collect data about other users without their consent.

9. Intellectual Property

The Service, including its design, code, trademarks, and content (excluding User Content), is the exclusive property of Prum AI and its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL MEET YOUR EXPECTATIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRUM AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time through the App settings. Upon termination, your license to use the Service immediately ends.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction, as permitted by applicable law.
